Gallpack is a product of TentaPack LLC. Artists upload their own work; TentaPack LLC hosts it. If something on Gallpack infringes a copyright you hold, this page says how to tell us and what happens next. It is written to follow the notice-and-takedown process in section 512 of the U.S. Copyright Act.
Who to write to
Designated agent: TentaPack LLC, an Illinois limited liability company, Chicago, IL. Email support@gallpack.com with "Copyright" in the subject. Registration of this agent with the U.S. Copyright Office's DMCA Designated Agent Directory is pending; notices sent to the address above are acted on in the meantime exactly as described here.
What a notice must contain
For us to act on it, a notice needs the six things the law asks for:
- Your physical or electronic signature, or that of the person authorised to act for the copyright owner.
- Which copyrighted work you say is infringed (a title, a link to where the original is, or a description; several works can go in one notice).
- Which material on Gallpack you say infringes it, with the link to the piece page, so we can find it.
- How we can reach you: a name, a postal address, and an email address or telephone number.
- A statement that you have a good-faith belief the use is not authorised by the copyright owner, their agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act for them.
A notice that knowingly misrepresents that material is infringing can make the sender liable for the costs it causes (17 U.S.C. § 512(f)). If you are not sure the use is infringing, say what you know and we will look.
What we do with a notice
- A person reads it, usually the same day. If it has the six things above, the piece comes off the site and out of search while we act; it is not deleted from the artist's studio.
- We tell the artist that the piece was hidden, why, and who sent the notice, and give them the counter-notice steps below.
- We reply to you to say what we did.
- If a notice is missing something, we tell you what, and act once it is complete.
The counter-notice
If your piece was hidden after a notice and you believe that was a mistake or a misidentification, you can send a counter-notice to the same address. It must contain:
- Your physical or electronic signature.
- Which material was hidden and where it appeared (the piece page).
- A statement, under penalty of perjury, that you have a good-faith belief the material was hidden by mistake or misidentification.
- Your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, for any district in which TentaPack LLC may be found), and that you will accept service of process from the person who sent the notice or their agent.
We send the counter-notice to whoever sent the original notice. Unless they tell us within 10 business days that they have filed a court action to restrain the use, we put the piece back up between 10 and 14 business days after receiving the counter-notice.
Repeat infringers
We keep a record of every notice. An account that receives three notices we have acted on, with no successful counter-notice, is closed; where it is clear sooner that an account exists to sell other people's work, we close it sooner. A closed artist's orders already placed still ship, and the money rules in the Terms still apply.
Reports that are not copyright
Work that is not yours but does not infringe a copyright — a piece that breaks theTerms in another way — can be reported from its page with the "Report" link, which follows the review process in section 7 of the Terms.
